OpenAI and Microsoft Joint Statement on Partnership Continuity

OpenAI and Microsoft have issued a joint statement confirming that their strategic partnership remains intact and central to both companies' operations. This announcement clarifies that recent funding rounds and new collaborations with other cloud providers do not alter the existing terms of their relationship, as previously outlined in October 2025.

Intellectual Property and Licensing

Microsoft maintains its exclusive license and access to intellectual property across all OpenAI models and products. The companies stated that collaborations between OpenAI and other entities, such as Amazon, were anticipated under their existing agreements and do not change the IP relationship.

Cloud Infrastructure and API Hosting

Azure remains the exclusive cloud provider for stateless OpenAI APIs. All stateless API calls to OpenAI models, regardless of whether they result from a collaboration with a third party like Amazon, must be hosted on Azure infrastructure.

Additionally, OpenAI's first-party products, including Frontier, will continue to be hosted on Azure.

Commercial and Revenue Sharing

The revenue share arrangement between Microsoft and Microsoft and OpenAI remains unchanged. This arrangement specifically includes the sharing of revenue generated from partnerships between OpenAI and other cloud providers.

AGI Definition and Governance

The contractual definition of Artificial General Intelligence (AGI) and the process for determining its achievement remains unchanged. This ensures that the process for governance and the process for determining if AGI has been reached remains consistent with previous agreements.

Infrastructure Scaling and Flexibility

While Azure is the exclusive provider for stateless APIs and first-party products, the partnership allows OpenAI the flexibility to commit to additional compute resources elsewhere. This includes large-scale infrastructure initiatives such as the Stargate project.

Partnership Design and Independence

The partnership was designed to allow Microsoft and OpenAI to pursue new opportunities independently while continuing to collaborate. Both companies maintain that they are working side-by-side to deliver AI tools and advance responsible development.
